GWINNETT CLERK OF COURT OPENS PASSPORT ACCEPTANCE OFFICE

(Lawrenceville, Ga., March 21, 2022) – Gwinnett County Clerk of Court Tiana Garner announced the opening of a new passport acceptance office today. Passport services are now available at windows one and two inside the lobby of the Office of the Clerk of Court.

What is eCertification?

eCertification is a software used by the Clerk's office to generate tamper-proof and self-validated certified copies of Court Records and Real Estate Recordings. Customers can purchase electronically certified and plain copies of records from the convenience of their home, their smart phone, or anywhere they have internet access 24-7, and upon processing by the Clerk's office, receive them as secured PDFs via email or online at https://ecert.gsccca.org. SEEKS CITIZENS TO SERVE ON BOARD OF EQUALIZATION

Veterans Day is an official United States Federal holiday that honors people who have served in the U.S. Armed Forces, also known as veterans.

The Gwinnett County Clerk of Superior Court Tiana P. Garner, is asking all veterans of all military branches of service to make sure their DD-214 is recorded at the courthouse. To record your DD Form 214 you will need one of the following:

1. Copy 4 of DD Form 214; or
2. Any copy of DD 214 with a raised seal issued by the United States National Personnel Records Center; or
3. United States National Archives Form 13038.

Garner stated, "I have discovered that many veterans do not know about this service and did not have their DD-214 recorded. Although veterans may have recorded their DD-214 in their home town or in a county or another state far away from Gwinnett, you are encouraged to record them here as well. 1. Mail in Renewal Applications are valid only for those current appointments from Gwinnett County that are within their 30 day expiration period.


2. Renewal Application must be completed on the Clerks' Authority web site at http://www.gsccca.org/Projects/npapp.asp (even if already expired, this is acceptable)

Effective January 15, 2020, it is the standing order of the Gwinnett County Magistrate Court to accept electronic filings through the Gwinnett County Clerk of Court's Electronic Filing Portal. Electronic filing in Magistrate Court is permitted, but not mandatory. All electronic filings shall be filed, signed and served in the form and manner set forth in O.C.G.A. 15-10-53.

Effective August 01, 2019, the Gwinnett County Clerk of Superior Court will only accept Central Filing Uniform Commercial Code (UCC) by electronic filing through TheGeorgia Superior Court Clerks Cooperative Authority portal. We will no longer be accepting paper filings by mail and/or from walk in over the counter customers.

For first time filers- electronic filing requires registration which can be accessed at https://efile.gsccca.org/home.aspx. A Support Tab is available with step by step instructions for easy registration and filing process. Once registered, you may begin efiling immediately.

MANDATORY E-FILING BEGINS JANUARY 1, 2019

In accordance with the provisions of O.C.G.A. §15-6-11 and O.C.G.A § 15-7-5, the Clerk of Courts of Gwinnett County began permissive E-filing on November 26, 2018, and E-filing will become mandatory for all state and superior civil cases via Tyler’s Odyssey eFileGA™ on January 1, 2019. Beginning on January 1, 2019, attorneys shall be required to electronically file all pleadings and any other documents to initiate a civil action or in a civil case in superior or state court. The following cases are exempt from the E-filing requirement: documents in connection with a pauper’s affidavit, any validation of bonds, pleadings or documents filed under seal or presented to the court in camera or ex parte, adoptions, and family violence protective temporary protective orders. The Real Estate Division accepts all electronic filings. All electronic filings can be made through the Superior Court Clerks’ Cooperative Authority (GSCCCA) eFile portal. You may register at: https://efile.gsccca.org/home.aspx. Assistance may be found on the Authority's web page under the Support tab.

Effective January 1, 2018 Senate Bill 132 amended Georgia law for all civil case initiation and disposition forms for superior and state courts, which are available on the clerk's website.

Title 9 of the Official Code of Georgia Annotated, relating to civil practice, is amended by revising Code Section 9-11-133, relating to forms meeting requirements for civil case filing and disposition, as follows:

"9-11-133.
The Judicial Council of Georgia, with the approval of the Supreme Court, shall promulgate forms to be used for civil case filing and disposition forms information; provided, however, that the general civil case filing information form and domestic relations case filing information form shall be required to contain an acknowledgment by the filer that the complaint and any exhibits or other attachments satisfy the redaction requirements of Code Section 9-11-7.1."

"19-9-1.2.Pursuant to Code Section 9-11-3, and in addition to the filing requirements contained in Code Section 19-6-15, in all proceedings under this article the plaintiff shall file a domestic relations case filing information form prescribed by the Judicial Council of Georgia." (Read more ...)

PUBLIC NOTICE

Invalid and Renewed Liens under the State Tax Execution Modernization Act

On December 31, 2017, all state tax liens issued by the Georgia Department of Revenue which have been filed and recorded in any county in Georgia will become invalid, subject to renewal as follows. Any active state tax liens which were recorded or rerecorded within seven (7) years before January 1, 2018 are eligible to be renewed by the Department. All renewed state tax liens will be valid for a single ten (10) year period from the date of renewal. Renewed liens will maintain priority as of the original date of filing. (Read more ...)

Official Code of Georgia Annotated Section 15-6-67(b), effective January 1, 2017, requires that all plats and condominium plans submitted for filing with the clerk of superior court shall be submitted electronically. The clerk of superior court shall file and record plats and condominium plans relating to real estate in the county when submitted for filing as provided in this Code section and accompanied with any required filing fees or costs set forth in Official Code of Georgia Annotated Section 15-6-77.

Effective January 1, 2018, all filing fees for maps and plats shall be paid through the Georgia Superior Court Clerks’ Cooperative Authority (GSCCCA) efiling portal at the time of submission. All maps and plats reviewed by and/or approved by the Gwinnett County Department of Planning and Development shall not be exempt from this filing fee requirement, and filing fees for all filers will be required at time of submission for recording through GSCCCA.org. STANDING ORDER

ORDER SETTING WARRANT APPLICATION FEE

Pursuant to authority granted the undersigned by O.C.G.A. 15-10-82, the filing fee for a criminal warrant application is hereby set at $15.00. This amount does not include the Law Library fee, which the Clerk of Court is required to collect pursuant to local act of the General Assembly and in accordance with the order of the Chief Judge of the Superior Court of Gwinnett County dated December 9, 2008 (08-AA-0443). The Law Library add on fee is $5.00. Therefore, the total filing fee (inclusive of the Law Library fee) for criminal warrant applications, unless waived by statue or the Court, shall be $20.00. In Senate Bill 255, the General Assembly has substantially rewritten Georgia's Garnishment Code. The revised Garnishment Code includes O.C.G.A. 18-4-6(b) which requires the Attorney General to develop a list of exemptions from garnishment and maintain the list on the Department of Law's website. The list has been developed and is available at www.law.ga.gov/garnishment-exemption. A copy of the list also has to be transmitted to each clerk of court who issues summonses of garnishment.

In looking for ways to break down language barriers, the Gwinnett Judicial Circuit and Clerk of Court have added the Google Translate application to the Clerk of Court website. The Google Translate icon is located in the top right hand corner of every page. By clicking on the drop down list, litigants can select the appropriate language and Google Translate will convert the entire webpage into that language.

The goal is to provide basic court information and foster a better understanding of the judicial process through language access before litigants get to court. However, the Gwinnett Judicial Circuit and Clerk of Court cannot guarantee the accuracy of the translations; therefore, litigants should still consult with an attorney for any legal advice and assistance.

PROOF OF ASSIGNMENT OF JUDGMENT REQUIRED FOR ALL GARNISHMENT AFFIDAVITS NOT FILED BY ORIGINAL JUDGMENT CREDITOR

Effective December 15, 2014, it is the standing order of the Gwinnett County Magistrate Court that a party filing a garnishment action who is not the original judgment creditor (i.e. judgment plaintiff) must, in addition to filing proof of an active judgment, file proof that the judgment has been assigned to the filing party along with the garnishment affidavit.

Gwinnett citizens have recently reported receiving phone calls telling them they missed jury duty and threatening a bench warrant. In some cases, the citizen is told to call a number to pay a fine. THIS COMMUNICATION IS A BOGUS NOTICE.

No one affiliated with the Gwinnett Judicial Circuit, the Clerk of Superior Court, or the Sheriff's Office communicates with jurors in this manner. To verify your status as a Gwinnett County juror you may call 770-822-8567. If you believe you received a jury scam call, email, or text message, please report it to the Jury Scam Tip line at 770-619-6655.

Domestic Violence Under Georgia Law, "family violence" is the occurrence of any felony, battery, simple battery, simple assault, assault, stalking, criminal damage to property, unlawful restraint, or criminal trespass between past or present spouses, persons who are parents of the same child, parents and children, stepparents and stepchildren, foster parents and foster children, or other persons living or formerly living in the same household, and does not include reasonable discipline administered by a parent to a child in the form of corporal punishment, restraint, or detention.

This worksheet must be filed timely in accordance with the requirements of the statute and local court orders. You will not get a hearing without your information being accurately supplied on a worksheet filed with the clerk's office.
